Mankato man reaches plea deal in assault www.privateofficer.com

MANKATO MN June 3 203 — A 50-year-old Mankato man who was arrested in April after he allegedly punched a Waseca police officer while they were at the hospital in Mankato has reached a plea deal that won’t result in prison time.
Jimmie Julius Herman pleaded guilty to a felony count of third-degree assault when he appeared in Blue Earth County District Court late last week. Felony charges of assaulting a police officer and making terroristic threats were dismissed in the plea deal.
Mankato police were called to the hospital at about 1:10 a.m. April 10 by a social worker who reported a Waseca police officer had been attacked. Hospital security officers had Herman handcuffed and lying face down on the floor.
The Waseca officer, John McGuire, reported Herman had been brought to the hospital after an incident in Waseca. Herman was living in Waseca at the time but now lives in Mankato.
Herman had become unresponsive after he was shot with a stun gun during a confrontation with an officer at a Waseca bar, according to the criminal complaint. An ambulance was called and the decision was made to bring Herman to Mankato for treatment. McGuire told Mankato officers he was assigned to follow Herman’s ambulance.
After Herman was treated and discharged by hospital staff, McGuire approached him while he was getting dressed. McGuire said Herman wasn’t showing any signs of being agitated, so he wasn’t prepared to have to defend himself. McGuire said he was punched in the face without any warning and knocked to the ground.
“Officer McGuire stated the punch caught him completely off guard and that he was seeing stars and the room started to spin,” the complaint said.
Herman also assaulted a hospital security guard who attempted to subdue him and threatened to kill a Blue Earth County sheriff’s deputy after he was restrained in a wheelchair.
The plea agreement says prosecutors won’t request prison time and any term of incarceration will be served in the Blue Earth County Jail. Herman, who has numerous disorderly conduct, assault and alcohol-related offenses dating back to 1990, will be required to complete substance abuse treatment, according to the deal.
He was in the Blue Earth County Jail, where he has been since his arrest. A warrant also has been issued for his arrest in Waseca County. Herman is still facing felony assault charges there for the incident in the bar, according to court records.
