Carlos Miguel Martinez, 45, was a first grade teacher at Northeast Independent School District's Montgomery Elementary School when the girl made an outcry of abuse last September. He resigned in March after being on administrative leave since October.
The district says it notified Child Protective Services andMartinez was placed on leave while they investigated. But he was returned to the classroom because the district says their investigation couldn't prove the allegations were true.
"After we completed our investigation, we could not substantiate the allegations," said NEISD spokeswoman Aubrey Chancello. "There simply was not enough credible evidence to justify leaving the teacher out. So he was returned to the classroom."
However, CPS's investigators felt otherwise, and notified the district that they felt the allegations were credible, and the district removed Martinez from the classroom again.
Martinez had been with the district for 14 years. He was released from the Bexar County Jail after posting $75,000 bond.
