Injured nightclub bouncer sues former employer www.privateofficer.com

Santa Fe NM March 22 2013 A former bouncer at Milagro 139, a downtown Santa Fe restaurant, bar and nightclub that closed last month, is seeking damages from the corporation that owned the business, claiming he sustained injuries three years ago when he tried to eject a group of drunken men.

Miguel Lopez claims bartenders continued to serve alcoholic beverages to about 10 men who were already visibly intoxicated at 1 a.m. March 20, 2010, although Milagro’s management knew they could be dangerous.

The complaint for personal injury and damages filed in state District Court on Friday by lawyer Robert Strumor says Lopez “asked the men to stop their altercation and leave peacefully, but they refused and continued fighting.” When he tried to escort some of them off the premises, the complaint says, several of them began punching him.
Lopez, who said he didn’t learn the identities of any of the men, suffered a fracture of his left hand, a break in his right hand and injuries to his right shoulder and ankle, the lawsuit says.
The complaint accuses Milagro 139 of breaching its legal duty to provide a safe environment for customers, agents, employees and contractors, and of failing to train and supervise its employees.
“The employees should have been instructed to escort all intoxicated persons from the premises and keep them from returning to the premises in an intoxicated state,” says the complaint, which asks a judge to award Lopez damages to cover his medical expenses, lost income, pain and suffering, loss of enjoyment and disfigurement or impairment.
Restaurateur John Beaupré, who was not available for comment Tuesday, opened the first Ore House in Sun Valley, Idaho, in 1966 and went on to open several others around the West. In late 1976, he bought out a friend’s burned-out bar on the southwest corner of the Santa Fe Plaza and opened an Ore House on the second floor at 50 Lincoln Ave.
In 2009, he opened Milagro 139 at 139 W. San Francisco St. In 2011, he closed the Ore House, which was replaced by the Thunderbird Bar & Grill. Beaupré initially claimed he was consolidating the Ore House and Milagro restaurants, calling his newest business the Ore House at Milagro. But in February, he closed Milagro, too. His residence’s listed phone number was recently disconnected.
